What is a Demand Package?
A demand package paints a picture of the financial, physical and emotional difficulties that you endured following a motor vehicle collision or other injury.
The demand package will be sent to the at-fault party’s insurance company. This gives the insurance company a fair chance to resolve the claim short of litigation. It is typically prepared after treatment has been concluded and contains all the supporting documentation for the damages incurred, as well as a letter summarizing those damages.
In Washington, we typically demand two types of damages:
- Special Damages
- General Damages
Special damages include costs such as medical bills, mileage expenses and lost income, which have an easily-quantifiable value.
General damages, also known as “pain and suffering“ are more difficult to place value upon since the value is not clearly defined in the same way as special damages.
The attorneys at Washington Law Center ensure accuracy of your special damages and dive as deep as possible into your general damages so the insurance company will understand the full risk if they chose to litigate.
What is the Purpose of a Demand Package?
The purpose of a demand package is to present evidence that the damages are reasonable, necessary, and related to the motor vehicle collision or other injury in the hopes of settling the case without having to litigate.
Litigation can be expensive and time-consuming and not the right choice for everyone. A poorly put together demand package can deter the insurance company from forcing a clear, reasonable case into litigation.
Like a personal injury attorney, the insurance company will examine the results of prior arbitrations and trials to determine what might be awarded in litigation. This helps them determine whether the costs of litigation outweigh the costs of settling.
The attorneys at Washington Law Center use their extensive knowledge and expertise to analyze your case on an individual basis to give you the best advice for your particular claim.
What Happens Once the Demand Package is Sent?
Once we receive your authority to send the demand package, your attorney will give them about thirty (30) days to receive, review and present its first offer. Each offer your attorney receives will then be presented to you. They will give you their opinion as to whether to accept the offer, respond with a counter-demand, or litigate. However, the final decision will always be yours.
